Do not use and access the Site if you do not expressly consent to the terms, conditions and notices contained in the Privacy Policy and in the Terms of Use Agreement. Types of Information Collected by HiNote

The most common information we collect is the information you voluntarily provide to us. For instance, when you create an account with us or contact us through the online portal provided on our Site to ask questions or subscribe to our newsletter, we ask you to provide certain personal information, such as your name, company, email address, location, and other contact details. If you contact us by phone, email, social media, or by some other means, we may keep a record of that correspondence and any information that you submitted in connection therewith. When we send you emails, including newsletters, we may also track if you open them. We may also collect other content and information you share by commenting on or participating in online forums and similar social media communities, or when you otherwise interact with us by any other means. If you want to purchase our products from the Site, it is our policy to redirect you to a third-party merchant. The Site may ask you to enter information about your location in order to direct you to the retailer nearest to you. Or the Site may direct you to a third-party online retailer. Please refer to those third-parties’ privacy policies and terms of use to learn more about their privacy practices, which we do not control. You may also purchase our products over the phone with one of HiNote’s customer service representatives. The phone representative may request certain personal information in order to complete the transaction, such as your name, company, email address, shipping address, phone number and other contact details. They may also request payment information, such as your credit or debit card number or your bank account number in order to process payments from you or to remit payments to you in connection with your purchase. When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, and date and location of the transaction.

We (and our service providers) may collect information about how you use and interact with the Site using various technologies, such as cookies or web beacons. A cookie is a small text file that any website, including ours, places in your internet browser to save your preferences. We may use cookies to collect information about your location, your browser, when you accessed the Site and for how long, the website address that linked you to our Site, and the website you visited after leaving our Site. We may also use cookies to share information with other websites, media partners and social networks in order to offer you pertinent promotional and advertising communications that match your interests (third party cookies). We (and our service providers) may use cookies and similar tracking technologies to monitor your shopping cart activity, including items you add to your cart, when you initiate the checkout process, and when a cart is abandoned. This information allows us to understand your shopping preferences and to provide a more tailored Browse experience. For the purpose of sending abandoned cart reminders, we specifically utilize cookies and website plugins to identify when items have been left in a cart without completing a purchase. This enables us to trigger reminder communications to help you complete your order.

HiNote may use a video (“Video”) from a third-party website or third-party service provider. Use of this video feature may be shared with third parties for the purposes outlined in this Privacy Policy, in accordance with applicable law, including for marketing and analytics. We use tracking technologies throughout our Site, including Meta pixels, and your viewing information of any such Video is subject to being collected, shared, and stored in accordance with this Privacy Policy and the privacy policy of our service providers, like Meta or Google. Your use of this feature constitutes your consent to such action, including but not limited to the consent required by Penal Code sections 632 and 631. If you do not consent, do not watch Videos on the Site. Your consent to this Privacy Policy followed by your voluntary access of and viewing of a Video on our Site represents your consent and agreement to any information collected, shared, and stored as a result of your viewing of and access of the Video.

HiNote may enable a live chat feature (“Live Chat”) administered by a trusted service provider on the Site. By voluntarily participating in the Live Chat, you consent to the recording and sharing of your conversation for the purposes outlined in this Privacy Policy, in accordance with applicable law, including for marketing and analytics. If you do not consent to the recording or sharing of your conversation as outlined in this section, please do not use the Live Chat feature. Your use of this feature constitutes your consent to such action, including but not limited to the consent required by Penal Code sections 632 and 631. If you do not consent, do not utilize the Live Chat feature on the Site. Your consent to this Privacy Policy followed by your voluntary use of this Live Chat feature on the Site and your voluntary submission of information on the Live Chat feature on the Site represents your consent and agreement to any information collected, shared, and stored as a result of your use and access of the Live Chat feature.

This Privacy Policy gives you express notice of and explains how we use cookies and the choices you have. Please note that if you choose to remove or reject cookies, this could affect your use of and the functionality of our Site. Further, we only want to communicate with those who want to hear from us. Requests to remove or update your contact information may take up to fifteen business days.

Storage of Data

For example, it may be necessary to store personal data regarding pending or future legal disputes, or for things like maintaining and improving our Site and our products, or for keeping our systems secure, or for maintaining appropriate business and financial records. Our Site may contain links to websites operated and maintained by third parties, over which we have no control, including social media websites hosted by third-party providers. The Global Distribution of our Products

We have authorized distributors located outside of the United States. Your information may be transferred, transmitted to, stored, or processed in the United States or other areas located outside your country as necessary for us to provide our Products to consumers throughout the world. We may utilize third-party platforms, domains, and other third-party service providers located outside your country to assist us in the global promotion, sale and distribution of our products. We carefully select business partners that have effective security measures and safeguards in place, however you should consult their terms of use and privacy policies, which we have no control over, to determine how they collect and use data. Because some recipients of your personal data are located outside your country, please note that protection laws may provide a different level of protection than the laws in your country.

If you are a California consumer, the information below also applies to you and supplements the terms of this Notice. If you are a California consumer and current or potential employee of HiNote, this Notice and these additional terms are further supplemented by HiNote’s internal employee privacy policies, which are not disclosed herein. We reserve the right to deny your deletion request if we determine that retaining the information is necessary for us or our service provider(s) to: attend to pending or future legal disputes; keep our websites and systems secure and identify and repair errors that impair site functionality; maintain appropriate business and financial records; complete the transaction for which we collected the personal information or otherwise perform our contract with you; detect or protect against fraudulent, or illegal activity, or prosecute those responsible for such activities; ensure the right of free speech; comply with a legal obligation; or make other internal and lawful uses of that information.

When You join a Path or Workout program, start a workout or recipe, share to the feed, or otherwise use or interact with the App, We may collect information related to Your current fitness level, when You prefer to exercise, Your number of workouts, exercises completed, workout streak, most common exercise, reps completed, active time, total workout time, Your path, Your achievements, how You would like to receive notifications, and any other content You choose to upload, including photographs and comments.

When You contact us with a comment, question, or complaint, We may collect information such as Your name or email address, along with any additional information We may need to help us answer Your question or respond to Your comment or complaint.

Food Journal and Calorie Tracking Data

When you use the Food Journal or enter information to calculate calories burned, we may collect optional data such as your date of birth, gender, height, weight, calorie goal, calories burned, and calories consumed, along with any food and drink items you add or barcode scan. This data is not shared externally, except as described below in connection with our nutrition data provider.

Nutrition Database (FatSecret Platform API)

To power food search, barcode lookup, and nutrition information in the Food Journal, we use the FatSecret Platform API, a third-party nutrition database service. When you search for a food, scan a barcode, or otherwise look up nutrition information, your search query or barcode is sent to FatSecret so that matching results can be returned to you.

We do not transmit any personally identifiable information (PII) about you to FatSecret in connection with this service — FatSecret does not receive your name, email address, account identifier, or any of the personal or health data you enter into the Food Journal (such as your weight, calorie goals, or food log entries). FatSecret has also confirmed that it does not store end-user data from queries made through the Platform API. FatSecret operates under terms that commit it to comply with all applicable laws, which supports our own compliance with regulations such as HIPAA and GDPR.

Integration with Apple Health
If you choose to integrate HiNote Life with Apple Health, we may use data like your date of birth, gender, height, weight, and calories burned through other Apple Health activities to calculate calorie goals and burned calories in the HiNote Life Food Journal. Apple Health integration is also optional, and you can use all features without linking your Apple Health data.

We may also collect information about You from third-party sources, including social media providers. The Website provides links to our Facebook, Instagram, X and TikTok accounts. If You connect with these websites through the Website, We may receive personal information about You, including information related to actions You take within social plugins, such as share buttons.

Facebook Login (Formerly Facebook Connect).  We use Facebook Login/ Facebook Connect to facilitate single sign-on for our users.  When You use Facebook Login/ Facebook Connect, We may be able to retrieve Your name, Instagram username and bio, profile photo, and email address. Sign in with Apple We use Sign in with Apple to facilitate single sign-on for our users. When You sign in with Apple, We may receive Your name, email address, and a unique identifier that enables You to sign in with Your Apple ID. Sign in with Google We use Sign in with Google to facilitate single sign-on for our users.  When You use Sign in with Google, We may be able to retrieve Your name, profile photo, and email address. You may use some portions of the Service without providing any personal information, though We automatically collect information regarding each user of the Service, including device IDs or identifiers (including mobile advertising identifiers if you opt-in), connection information, statistics of page views, ad data, referral URLs, IP address, general geographic location, the domain name of Your Internet service provider, the Service features You use and the time of Your use, page requests, browser type, information related to Your device information (e.g., device model, software, and operating system version), and aggregated information that cannot be used to specifically identify You when You use the Service. To send periodic emails relating to Path Holdco Inc’s products and services. If You choose, the email address You provide may be used to send You occasional newsletters, updates, related product or service information, etc. Note:  If at any time You would like to unsubscribe from receiving future emails, We include detailed unsubscribe instructions at the bottom of each email. Please note that if You opt out from receiving marketing-related emails, We may still need to send You communications about Your use of our products or services, or other matters;

To generate and review reports and data about our user base and Service usage patterns;To analyze the accuracy, effectiveness, usability, or popularity of the Service;

A. Third Party Service Providers and Business Partners. We may use third-party service providers and business partners to perform functions in connection with the Service, such as marketing, website hosting, site analytics, relationship management, functions related to analyzing and improving the Service usefulness, reliability, user experience, and operation, storing data, and as otherwise described in this Privacy Policy. Any third party with which the App shares Your data will provide the same or equal protection of Your data as stated in this Policy.  Our third-party business partners and service providers may only use and disclose Your personal information for the limited purposes for which it is provided. When our business partners and service providers no longer need Your personal information for those limited purposes, We require that they dispose of the personal information.  In some circumstances, We may permit our service providers to retain aggregated, anonymized or statistical information that does not identify You.

Facebook Login. We use Facebook Login/ Facebook Connect to facilitate single sign-on for our users. When You use Facebook Login/ Facebook Connect, We may disclose information related to Your device, the websites You visit, the purchases You make, the advertisements You view, and information regarding Your activities on the Service. RevenueCat. We use RevenueCat to manage user subscriptions to the App. RevenueCat may collect Your in-app purchase receipts. RevenueCat may also collect information related to country, device type, operating system, RevenueCat Purchases SDK version, the last time a user used the App, and App User ID. In-App Messaging and Engagement. We may use third-party in-app messaging and engagement services to deliver notifications, news, and offers related to the HiNote Life app and to better understand how users interact with the Service. These providers process limited usage information solely to deliver these communications and to generate aggregated reports that help us improve the Service. To opt out of these messages or to request additional information about the providers we use, please email us at privacy@hinote.com.

Segment. We analyze the usage of the HiNote Life app and website by using the services of Segment, 100 California Street Suite 700 San Francisco, CA 94111 United States. Leanplum uses the collected data to create reports about user behavior, which help us to provide a better product. You can find Segment’s Privacy Policy here. To disable the collection of your data by Segment please send an email to privacy@hinote.com.

Google Analytics. We analyze the usage of the HiNote Life app and website by using the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, California 94043, United States. Google Analytics uses the collected data to create reports about user behavior, which help us to provide a better product. You can find Google’s Privacy Policy here. To disable the collection of your data by Google please send an email to privacy@hinote.com.

Product Analytics. We may use additional third-party product analytics services to help us understand how users interact with the HiNote Life app and to improve the Service. These providers create aggregated reports about user behavior on our behalf and process information only as needed to provide their services to us. To disable the collection of your data by these analytics providers, or to request a current list of providers we use, please send an email to privacy@hinote.com.

B. Other HiNote Life Members.  If You choose, information related to Your workouts, successes, name, and profile picture (including any photos or comments You may choose to post) may be shared with other HiNote Life members.

C. Apple or Google.  We may share Your information with Apple or Google, to be used in accordance with their respective privacy policies.

Specifically, We offer users the option to sign into the App with Apple, Facebook or Google. The first time You sign in with Apple, Facebook or Google, Apple, Facebook or Google generates a unique token associated with each user, and stores the email address that You shared with us. Using this information, Apple, Facebook or Google facilitates secure authentication, and enables You to manage and view Your account details. Subsequent visits to the App do not require sharing additional information with Apple, Facebook or Google.

We also use App Store Connect and Google Play to manage all in-app purchases. We also use App Store Connect and Google Play to offer promo-codes to VIPs. We further use App Store Connect and Google Play to manage the marketing materials that You see in the App Store and our Beta test program through an Apple Product TestFlight. Finally, We use App Analytics (offered through App Store Connect and Google Play) for analytics and sales/financial reporting. App Store Connect and Google Play may collect session and crash data, unique device identifiers, device make and model, and time of install. You also have the option to transmit the data collected by the Service via interfaces provided by Apple and Google, such as Apple HealthKit and Google Fit, to track Your progress and to help motivate You to keep going and stay the path. When You track Your progress by saving workout data in Apple HealthKit or Google Fit, We read the following data securely from Apple Health and Google Fit: steps, calories burned, and calories consumed. We write the following information related to workouts: total time, start time, finish time, and source. This will only happen if You explicitly agree to share Your data. You can change the permissions You grant the App at any time, using either the in-app settings or Apple Health or Google Fit. Data gathered from Apple HealthKit or Google Fit may not be used (including by third parties) for marketing, advertising, or use-based data mining.

Finally, We enable You to share photos post-workout using Apple or Google native sharing functionality, which will allow You to share pictures including by posting them to Your social media account. 

D. Fit in 52, LLC.  We may share Your information with Fit in 52, LLC, the company with which We are working to deliver the Service to You.

E. Business Changes. If We become involved in a merger, acquisition, sale of assets, joint venture, securities offering, bankruptcy, reorganization, liquidation, dissolution, or other transaction, or if the ownership of all or substantially all of our business otherwise changes, We may transfer Your information to a third party or parties in connection therewith.

F.  Affiliates. We may also share Your information with our affiliates for purposes consistent with this Privacy Policy. Our affiliates will be required to maintain that information in accordance with this Privacy Policy.

G. Investigations and Law. We may disclose information about You to third parties if We believe that such disclosure is necessary to:

• Comply with the law or guidance or cooperate with government or law enforcement officials or private parties, including responding to requests from government or law enforcement officials or private parties outside your country of residence;

H. Aggregated Information. We may share aggregated information relating to users of the Service with affiliated or unaffiliated third parties. This aggregated information does not contain personal information about any user.

I. Analytics. We use third-party analytics tools to better understand who is using the Service and how people are using it. These tools may use cookies and other technologies to collect information about Your use of the Service and Your preferences and activities. These tools collect information sent by Your device or the Service and other information that assists us in improving the Service. This information may be used to analyze and track data, determine the popularity of certain content, and better understand Your online activity, among other things.

We also use Google Firebase Performance Monitoring and Google Analytics for Firebase to collect application usage information to help us gather and analyze information on the App’s performance and how users engage with it to evaluate and improve the App experience. Firebase Performance Monitoring may collect information related to general device information (such as model, operating system, and orientation), RAM and disk size, CPU usage, carrier (based on mobile country and network code), radio/network information (i.e., WiFi, LTE, 5G), country (based on IP address), locale/language, signal strength, jailbroken or rooted status of device, battery level and battery-charging state, App version, App foreground or background state, App package name, App-instance identifier, network URLs (and the corresponding information: response codes, payload size in bytes, and response times), and duration times for automated traces. Google Analytics for Firebase collects information related to Your interactions with the App, including information related to advertisements and Your interactions with advertisements, information related to Your interaction with the App and App data, information related to the performance of the App and updates to the App, and information related to Your in-App purchases. J. Cookies and Other Tracking Technologies

We, along with third parties, use cookies, local storage objects, Web beacons, mobile advertising identifiers and other technologies. These technologies are used for tracking, analytics, and personalization and optimization of the Service.

Cookies are small files that are transferred to and stored on Your computer through Your Web browser (if You allow it) that enable the website’s or service provider’s system to recognize Your browser and capture and remember certain information. You can instruct Your browser to stop accepting cookies. But, if You do not accept cookies, You may not be able to use all portions of all functionality of the Website.

We use standard and dynamic remarketing features in Google Ads and Google Analytics to show customized ads to users who have previously interacted with the Website. We and our third-party vendors, including Google, use cookies and device identifiers to inform, optimize, and serve ads based on Your past visits to our Website. Google, and other third-party vendors, show our ads on websites across the Internet. We also use cross-device linking in conjunction with our Google Ads campaigns. As part of those campaigns, We share unique anonymous identifiers with third parties to facilitate reporting and advertising across user browsers and devices.

We also use the Meta (formerly Facebook) Pixel to analyze user activity on our Website for remarketing and behavioral targeting. The Facebook Pixel is triggered to establish a connection with the Facebook servers when You perform certain activities on the Website. Facebook links the information with Your personal Facebook user account, and allows us to display Facebook ads to Facebook's users who have visited our Website. Some of our business partners, such as our analytics providers and advertising networks, also use cookies and other tracking technologies on our Service, some of which may track users across websites and over time.

If You have reason to believe that Your interaction with us is no longer secure (for example, if You feel that the security of any information that You provided to us has been compromised), please contact us immediately using the contact information in the “How to Contact Us” section below.

Any information collected through the Service is stored and processed in the United States and Canada. If you use the Service outside of the United States and Canada, You consent to having Your data transferred to the United States and Canada. While Your information is stored and processed outside of Your country, it is subject to the laws of the country in which it is located, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country.

HiNote Life operates in multiple jurisdictions, some of which are not located in the European Union or European Economic Area (EEA). The personal information that we collect from users will be stored in the United States of America and Canada and might also be shared with third party data recipients (e.g. customer support providers) that are not located in the EEA. Therefore, the personal information that you provide to us may be transferred internationally to countries other than the country in which you initially provided your data.

VI. Data Retention Policy, Managing Your Information

We will retain Your information for as long as You use the Service and for a reasonable time thereafter to a maximum of 5 years, or as permitted by law. We may maintain anonymized or aggregated data, including usage data, for analytics purposes. We may retain and use Your information as necessary to comply with our legal obligations, resolve disputes, and/or for the period required by laws in applicable jurisdictions. You have choices regarding the use of information by the Service.

Changing Your Information – You may request to update, or have deleted, any personal information collected from You through the Service.  Just send us an email at privacy@hinote.com asking to update Your personal information, or to have us delete Your personal information.  However, We reserve the right to retain personal information as necessary for our business purposes, and to comply with laws. 

Closing Your Account – You may close Your account by contacting us at privacy@hinote.com.  If the email account associated with Your email address is not active, We may close Your account without notice.

IX. Choices Regarding Your Information for app users who are EU/EEA residents

Residents of the European Union or European Economic Area also have the following choices regarding the user of information by the Service.

Request information about whether we hold personal information about you, and, if so, what that information is and why we are holding/using it;

XV. Your Nevada Privacy Rights

Senate Bill No. 220 (May 29, 2019) amends Chapter 603A of the Nevada Revised Statutes to permit a Nevada consumer to direct an operator of an Internet website or online service to refrain from making any sale of any covered information the operator has collected or will collect about that consumer. We will take steps to ensure that Your personal information is kept as accurate, complete and up-to-date as reasonably necessary.  We will not routinely update Your personal information, unless such a process is necessary.  We expect You, from time to time, to supply us with updates to Your personal information, when required.

You may make a written request to review any personal information about You that We have collected, used or disclosed, and We will provide You with any such personal information to the extent required by law.  You may also challenge the accuracy or completeness of Your personal information in our records. Fit in 52 LLC Privacy Policy

This privacy policy describes the type of information Fit in 52 LLC and our affiliates (collectively, “Fit in 52”, “we”, “us”, and “our”) collects, uses, and shares when you use the HiNote Life application (the “App”) and any other location where this Privacy Policy is made available to you (the “Service”). This privacy policy also informs you of your rights and choices with respect to the information we collect about you.

We act as a data controller and are responsible for our processing of personal data by the Service under applicable privacy and data protection laws.

STORAGE AND RETENTION OF INFORMATION

We will retain the information we collect in accordance with applicable laws and as reasonably necessary for our processing purposes set out under this privacy policy, including resolution of disputes, enforcement of agreements, securing the Service, and to comply with our legal obligations. When personal data is no longer necessary for our purposes we will delete or deidentify the data.

We will also take steps to ensure that the information we collect is treated securely and in accordance with this privacy policy. We have put in place technical and organisational procedures designed to safeguard the information we collect. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect the information we collect, we cannot guarantee its security.

CHILDREN

Our Service is not directed toward children (as defined by local law) nor does Fit in 52 knowingly collect information from children (as defined by local law) without parental consent except where in compliance with applicable laws.

INTERNATIONAL TRANSFERS 

We are based in the U.S. and the information we collect is governed by U.S. law. If you are accessing the Service from outside of the U.S., please be aware that information collected through the Service may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence. Your use of the Service or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in the U.S. and other jurisdictions as set out in this privacy policy. If your data is collected in the European Union, the United Kingdom, or Switzerland (collectively, the “EU”), we will transfer your personal data subject to appropriate or suitable safeguards, such as Standard Contractual Clauses.

This section of the privacy policy applies only if you use the Service from a country that is a Member State of the European Economic Area and supplements the information in the privacy policy.

Fit in 52 collects and uses personal data as described in the “Information we collect” and “How your information may be used” sections above. We may disclose personal data about you as described in the “How your information may be shared” section above. Fit in 52 may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

You may be entitled, subject to validation of your identity and in accordance with applicable law, to:

        Confirm whether we process the consumer’s personal data and to access such information;

        Correct inaccuracies in personal data;

        Delete personal data;

        Data portability;

        Withdraw consent you have previously given; and

        Object to or request the restriction of processing of your personal data.

 

Legal Basis for Data Processing: We process personal data for the purposes set out in the privacy policy. Our legal bases to process personal data includes processing that is: necessary for the performance of the contract between you and us (for example, to provide you with the services you request and to identify and authenticate you so you may use the Service); necessary to comply with legal requirements (for example, to comply with applicable accounting rules and to make mandatory disclosures to law enforcement); necessary for our legitimate interests (for example, to manage our relationship with you and to improve the Service); and based on the consent of our customers (for example, to communicate with you about our products and services and provide you with marketing information), which may subsequently be withdrawn at any time (by using preference settings found in our emails/Service or by contacting Fit in 52 as described above) without affecting the lawfulness of processing based on consent before its withdrawal.

We may use automated decision-making technologies, including profiling, to support our data processing activities. Our automated decision-making capabilities include logic that attempts to identify artists, music, communications, products, or offers that we believe may interest you. By using this logic, it helps us personalize your interactions with Fit in 52. For you, this means that you may see online advertisements, direct marketing communications (if you have subscribed), or other advertising or marketing messages or special offers based on your activity on our Service or interactions with Fit in 52 or our partners. 

In some instances, you may be required to provide us with personal data for processing as described above, for us to be able to provide you to use all the features of the Service.

Complaints: You may also be entitled, in accordance with applicable law, to lodge a complaint with a supervisory authority if you consider that our processing of your personal data infringes applicable law. We would, however, appreciate the opportunity to address your concerns before you approach a data protection regulator, and would welcome you directing an inquiry first to us. We use partners to enable targeted advertising on social media platforms, websites, and mobile apps that are not owned or operated by us.
